Win property listings with AI: lawful channels and limits
Win property listings with AI through valuation requests, local letters and CRM, with compliant agency mandates, avoiding bought lists and cold calls.

Acquire real estate assignments with AI it works when the owner takes the first step, or when he has given you permission to contact him again: the request for evaluation from the site, the letter on the area to which he has subscribed, the customer who has already bought with you, who at the first meeting said "let's talk again in spring". There the assistant immediately answers, prepares the inspection and holds the wire for months; in addition, he reads the archive of negotiations and shows where the assignments that close come from.
It does not, however, make cold outreach lawful. Calling or messaging a private individual on WhatsApp because they are selling a home on a property portal, or contacting owners on a street using a list to offer an agency mandate, is marketing. In 2025, the Italian data protection authority fined a company one hundred thousand euros for selling lists of property owners to agencies, and then sanctioned the first nine agencies that used them, with fines of up to forty thousand euros (Newsletter of the Guarantor of 30 May 2025).
Requests from the portals, announcements, visits and file of the property are treated in the AI Guide for Real Estate Agencies.
In summary
- Proposing the assignment to an owner is a promotional communication: email, SMS, WhatsApp and automatic calls require prior consent (Art. 130 of the Privacy Code).
- The numbers found on a site, in a list or in a public register are no exception (guidelines of the Guarantor on spam).
- The lists of owners by area, with cadastral data and telephone numbers, are the «card» sanctioned by the Guarantor in 2025.
- Those who make promotional calls, even with an operator, must consult the Public Opposition Register every month and before each campaign.
- AI makes more where the owner comes forward: evaluation requests, area letters with consent, past customers, agreed contact details.
- The assistant fills out the submitted commission form; commission, expenses, duration and exclusivity are decided by the agent with the owner.
The number in a private person's ad: why he is not a contact to propose the assignment
A private seller who publishes their mobile number under “three-room flat for sale, no agencies” has provided it to people who want to view the property. Calling them to offer agency services changes the purpose of the contact, and the purpose is what matters. For email, SMS, MMS, faxes and calls made by automated systems without a human operator,Article 130 of the Privacy Code requires the person’s consent before sending.
WhatsApp follows the same rule. In a measure of 13 March 2025 the Guarantor qualified as promotional the messages with which an agency proposed its services to those who might want to sell, and recalled that consent is also used when numbers come from websites, lists or public registers. It is the same line as the 2013 guidelines on spam.
A call made by a human operator falls under paragraph 3 of the same article, which is no more permissive. One agency claimed that it called owners only to ask whether they wanted to sell: the data protection authority still considered this promotion. It found undocumented consent, no privacy information during the call and no checks against the public opt-out register, and imposed a fine of ten thousand euros (measure of 13 March 2025, doc. web 10120517).
Then there is to say to the person where you took her data. If you did not collect them from her, the Article 14 of the GDPR asks to inform it at the latest at the first contact, indicating also the source, and in any case within one month of collection. The general framework on consent and legal bases is in the guide on GDPR and artificial intelligence in the company.
From which contacts the agency can start: the source map
Before connecting an assistant to the CRM, you need to know which contacts can receive an assignment proposal.
| Where the contact comes from | Can you propose the assignment? | The Rule |
|---|---|---|
| Mobile in a private ad on a portal | No, without prior consent | Promotional Communication (art. 130 Privacy Code); data taken from websites are no exception |
| List of owners of an area bought from a supplier | Only with proof of a specific consent to your agency | The consent given to the supplier does not go chain to the other holders (Garante, 16 January 2025) |
| Crossed cadastral data with phone numbers | No | It is the mapping of the territory sanctioned by the Guarantor in 2025 |
| Evaluation request filled in on your site | Yes, to answer that request | Pre-contractual measures requested by the data subject (GDPR, Art. 6); for other mailings a separate box is needed |
| Inscribed to the letter on the area | Yes, until it revokes | Specific consent, revocable at any time |
| Customer who has already bought or rented with you, via email | Yes, for similar services | Exception of paragraph 4 of Article 130, if he had been informed and did not oppose |
| Number in a public telephone directory, call with operator | Only if it is not registered in the Opposition Register | Law 5/2018, art. 1: consultation every month and before each campaign |
What the Guarantor found in the lists of owners by area
The case arises from a company that provided agencies, area by area, with the list of owners with telephone and cadastral data. According to the measure of 16 January 2025, property data came from public registers, including the SISTER service, and was matched using tax identification numbers with personal records purchased from other suppliers. The data protection authority found that consent collected by the first supplier did not cover the subsequent transfers to agencies: the fine was one hundred thousand euros.
The client agencies were sanctioned next. One had sent WhatsApp messages to 500 numbers from those lists and was fined three thousand euros; in the same decision, the data protection authority stated that an indemnity clause in the supplier contract does not relieve the agency of its duty to check privacy information and consent (doc. web 10121182). In the most serious cases, the Authority has prohibited any further use of the data and has imposed its cancellation (30 May 2025 Newsletter).
If a provider offers you ‘already agreed’ numbers, ask and save the following before uploading them to the CRM.
- The proof of consent of each contact, with date, channel and text that the person has accepted.
- A specific consent to the communication of data to your agency, not to generic "business partners".
- The information given by the first owner, with the indication of the source of the data.
- The outcome of sample checks made by the agency, in addition to the guarantees written in the contract.
- Verification in the Public Opposition Register, repeated every month if you telephone.
- A way to record who opposes it, so that no colleague calls it back.
Assessment Requests, Zone Letters, Contact Us: What AI Assistant Does
When the owner asks how much his house is worth
The request form on the site is the cleanest channel: the person writes because they want an answer, and you can use their data to give it to them. The assistant also answers in the evening and asks what the agent needs: address and floor, state of the property, times, if there is another house to buy, if there is already an assignment with another agency. Then he proposes two times for the inspection. How do you get to the figure, and where the automatic estimates stop, explains the guide to real estate valuation with AI; for answer texts you can start from prompt for real estate agents.
Two precautions. The assistant claims to be an AI system, as requested by the Article 50 of the AI Act from 2 August 2026. And in the form the box to receive updates and proposals is separated from the request and has not already checked. Setting and limits are in the guide to chatbot for the company site.
The area letter for those who signed up
Those who do not want to sell today gladly read what happens in their neighborhood. The Revenue Agency publishes every semester the OMI Quotes, a minimum and maximum range in euros per square metre by area and type, and warns that they are broad maximum indications that do not replace the estimate of a technician. With that figure, the trades followed by the agency and the news of the area (yards, stops, schools), the assistant prepares the draft of the letter; the agent rereads it and signs it.
The letter leaves only to those who have signed up, in the agency or on the site, with the link to cancel in each sending. Who signs up to follow the prices of his way is the most likely contact when he decides to sell.
Past customers and owners who said "not now"
An agency's CRM contains expired assignments, buyers become owners, people met at an evaluation they asked to resent. The assistant records for each contact what he asked for and when, and prepares the message on the agreed date. For the email to those who have already used your services, the exception of paragraph 4 of article 130 applies: similar services, information given at the time of collection, possibility to oppose in each message. How not to lose contact is the theme of the guide on Follow-up automation.
Anyone who asks not to be contacted should be marked immediately, so that no colleague calls him the next month. It is one of the measures that the Guarantor has imposed on sanctioned agencies: to keep track of people's denials and changes of will (measure of 13 March 2025).
Voice agents: answer yes, call cold no
A voice agent who answers the phone when everyone is visiting is useful: he takes the data, fixes the inspection, alerts the agent. Used to call out a list of owners becomes an automated operatorless call system, the case of paragraph 1 of Article 130, which requires consent. The Law 5 of 2018 also prohibits composers who search for numbers automatically, including those outside the lists. Uses and limits of the entry are in the guide to voice AI for companies.
The negotiations you already have on file: what they say about tomorrow's assignments
Before looking for new contacts it is better to read the old ones. From the notes of the meetings and the signed or nuanced assignments, the AI gets answers that in the agency rarely find time: from which channels come the assignments that end with a deed, after how many meetings an owner signs, because those who asked for an evaluation did not sign.
The most useful job is to classify the reasons handwritten by the agents: expected price higher than the valuation, commission, exclusive, times, a relative who tries to sell alone. A count made over two years of notes shows if the problem lies in the channel, area or way of presenting the assignment. They are internal analyses on data that the agency already deals with; recontacting people for promotional purposes remains a separate step. To connect them to the management software there is the guide to AI for CRM and Sales.
From inspection to signed assignment: what the assistant prepares
The Civil Code defines mediator who connects two or more parties to conclude a business without being linked to any of them by collaboration, dependence or representation (Art. 1754). The commission matures if the deal is concluded as a result of his intervention; if the parties have not fixed the measure are worth tariffs or uses, and failing that decides the judge according to fairness (Art. 1755). Expenses incurred on assignment must be reimbursed even if the deal is not concluded, except for contrary agreements or uses (Art. 1756).
That's why the written assignment counts. Measure of commission, expenses, duration and eventual exclusivity go on the form that the agency has deposited before using it, as required by Law 39 of 1989 (details in the General Guide). The same law recognizes the commission only to those who are enrolled (Art. 6); deleted the role, the registration is that in the business register or in the REA (D.Lgs. 59/2010, art. 73).
On the path to signing the assistant does four things, always under the control of the agent:
- Prepare the card of the first meeting: property data provided by the owner, contact history, questions still open.
- Fill in the deposited form with the data collected, without touching the clauses.
- Remember the fulfillments that take place at the assignment, starting from the appropriate anti-money laundering verification.
- It puts on the schedule the deadline of the assignment and a reminder a few weeks before, to renew or close it by talking to the owner.
Two agencies, two starting points
A neighborhood agency with two agents. Think of an agency in a residential area of an average city, living off requests from the site, signs and word of mouth. He puts an assistant on the evaluation form, starts the letter on the area and has the AI classify the notes of the last meetings. Let's say this emerges: closed assignments come from former clients and evaluation requests, those lost by the distance between expected price and evaluation. The agency knows where to put the time of the agents and what to bring to the first meeting.
An agency that bought listings. Another agency has worked for years with lists of owners provided by third parties and cold calls. The first step is to suspend its use and ask the supplier for proof of consent contact by contact; what has no proof is deleted, as the Guarantor has imposed in the most serious cases. Then the agents' work shifts from calls to answers. The contacts are less, but everyone knows who you are and why you call him.
The mistakes that bring a real estate agency before the Guarantor
- Trusting the ‘consented’ numbers and the supplier's indemnity.
- Sending WhatsApp in series to portal privates, thinking that a message weighs less than a phone call.
- Calling without a script with the disclosure, or without consulting the Opposition Register in the month.
- Using a voice agent for outgoing calls to those who have not given consent.
- Collecting from portals, with a scraping tool, owner cards that no one gave information to.
- Losing opposition: The owner who asked not to be called again receives a colleague's phone call.
How to get started without bought lists or cold calls
Start with the channel you already have, the evaluation form on the agency's website or email box. Connect an assistant who answers, asks the agent's questions, and fixes the survey, with the consent recorded in the CRM. After the first month add the letter about the area, and in the meantime have the AI classify the notes of the last year's meetings. Lists bought and cold calls remain out of the project from the start.
If you want to link site form, CRM and area letter in a single stream, with the consent of each tracked contact, the page AI for real estate describes what we can build for your agency.

Microsoft Copilot and Business Data: Privacy and PermissionsFAQ
Can I call someone selling their home on a property portal to offer an agency mandate?
The number published in the listing is intended for people interested in that home. Offering an agency mandate to the owner is promotional communication: SMS, email, WhatsApp and automated calls require prior consent, and the Italian data protection authority notes that data taken from websites, lists or public registers is no exception. The safe approach is to be found: a valuation form, signs, word of mouth and a local newsletter for subscribers.
Can I use area-based lists of property owners sold by suppliers?
Only if the supplier demonstrates, for each contact, the privacy information provided and specific consent to share the data with your agency. The Italian data protection authority has sanctioned both a company that matched land-register data with phone numbers and the agencies using those lists. An indemnity clause in the contract does not transfer responsibility: the agency must perform sample checks.
Can an AI voice assistant call the owners instead of my agents?
A call made by an automated system without a human operator falls under paragraph 1 of Article 130 of the Italian Privacy Code, which requires prior consent. The AI Act also requires people interacting with an AI system to be told that it is AI. A sensible use of a voice agent is answering incoming calls and calling back people who requested it.
Does Italy’s public opt-out register also apply to estate agencies?
Yes. Law 5 of 2018 requires anyone making promotional calls, with or without a human operator, to consult the register every month and in any case before each campaign, updating their lists. The Italian data protection authority cited precisely this failure in a case involving an agency calling owners from a purchased list.
Can I use my past negotiations to find new agency mandates?
Yes, for internal analysis: understanding which channels bring mandates, which areas perform well and why some owners do not sign. Contacting someone again for promotional purposes is a separate step requiring the appropriate legal basis. Emailing clients who have already used your services may fall under the exception for similar services, if they were informed and did not object.
What must an agency mandate contain to avoid commission disputes?
The commission amount, expenses, duration and any exclusivity must be written on the form the agency has filed with the Chamber of Commerce. If the mandate says nothing, the amount is determined by tariffs and customary practice or, failing those, by a judge; expenses must be reimbursed even if the transaction is not completed, unless agreed otherwise. The law recognises commission only for registered agents.
