Rental management with AI in the agency: from the tenant's request to the contract registered with the RLI model

The Rental management with AI it serves an agency that follows leases on behalf of the owners in the steps that are repeated for each contract: respond to requests on the ad, collect the documents of the candidates, fill out the right model, prepare the data for registration and keep the schedule of deadlines for years. Two decisions remain with people: who to give the house to and what to write in the contract.

The reason is concrete. A selection entrusted to an automatic score touches on the ban on only automated decisions of the GDPR, and a wrong filter on requests can become discrimination in access to housing. The rest is made of data to copy well and terms not to be missed, starting from 30 days to register the contract (Revenue Agency). Announcements and acquisition of owners are in the AI Guide for Real Estate Agencies and in the article on how acquire assignments.

In summary

  • The lease is registered within 30 days from the stipulation or from the beginning, if earlier; for real estate agents the sending is mandatory (Revenue Agency).
  • With the dry coupon the lessor waives the updates of the fee, including ISTAT, and must communicate it first to the tenant with a registered letter.
  • In agreed-upon fee contracts, the clause that exceeds the maximum fee of local agreements is void.
  • The AI checks the completeness and consistency of the documents; the choice of the tenant should not be entrusted only to an automatic score.
  • Filters on nationality, origin or religion, even indirect ones, are discrimination in access to housing.
  • In short-term rentals, the agency indicates the CIN in each ad and, if it collects fees, applies withholding tax as a substitute for tax.

The six steps of a lease, as seen by the agency:

  1. Request: the assistant responds with the announcement data and asks for date of entry, occupants, type of contract sought.
  2. Visit: sets the appointment in the bands agreed with the owner or the outgoing tenant.
  3. Documents: only ask for the necessary ones and check that they are complete, legible and consistent.
  4. Choice: decide agent and owner, on an equal summary for all candidates.
  5. Contract: fill in the chosen model (free, agreed, transient, students) with the data of the file.
  6. Registration and subsequent years: prepares RLI data and keeps the calendar of annuities, extensions and cancellations.

Requests on the rental ad: what the assistant asks and what he doesn't have to ask

Those who write for a two-room apartment for rent want to know if it is free, how much they cost rent and expenses, when you can enter. The assistant responds with the data of the card and asks what the agent would ask: date of entry, how many people will live in the house, if a transitional for work or study, animals, guarantees offered. Then he proposes the visit, declaring himself to be an AI (AI Act, Art. 50).

There are filters that you should not apply, even if the owner asks. The Single text on immigration considers it discriminatory to impose more disadvantageous conditions or to refuse access to housing to a resident foreigner on a regular basis solely because of his condition, race, religion, ethnicity or nationality, and the definition includes indirect behaviour. Equal treatment without distinction of race and ethnic origin applies to access to goods and services, including housing (Legislative Decree 215/2003, art. 3).

In automatic systems the risk lies in the indirect. An assistant who later answers to those who write in an uncertain Italian, or who proposes fewer visits to those who have a foreign surname, discriminates without anyone having decided. For this reason the instructions contain the list of allowed questions and are checked by sample on real conversations.

Candidate Documents and Tenant Choice: Where AI Stops

The decision on a candidate usually requires a proof of income (paycheck, employment contract or tax return), the data of a possible guarantor and, upon signature, the identity document. The principle of minimising GDPR asks for adequate, relevant and limited data for the purpose: before asking for an extra document, it is better to ask which decision is needed. Information about health or religious beliefs does not serve to decide on a rental.

The assistant reads the PDFs, checks that names and dates coincide and that nothing is missing, and prepares a summary with the same structure for each candidate. How to extract reliable data from different documents explains the guide to AI to analyze business documents.

Score doesn't decide The Article 22 of the GDPR gives the person the right not to be subject to a decision based solely on automated processing that significantly affects him or her; recital 71 cites automatic rejection of an online credit application. A system that discards candidates based on a solvency score, without a person rating, falls under this scheme. Even in the foreseen exceptions, contract or explicit consent, the right to human intervention, to express one's opinion and to contest the decision remains.

The AI Act then places among high-risk systems those intended to assess the creditworthiness of natural persons (Annex III, point 5(b), and in recital 58 explains that they determine access to essential services such as housing and may perpetuate discrimination (EU Regulation 2024/1689). With Omnibus regulation on AI the obligations for these systems apply from 2 December 2027. To those who propose a scoring of tenants ask how they classified it; the levels are explained in the guide to risk levels of the AI Act.

Free, agreed, transitional or for students: the right model for each contract

The type of contract the owner chooses, with the advice of the agent. The Act 431 of 1998 asks for the written form for each housing lease; the rest changes a lot from one model to another, and an assistant who compiles the wrong model produces out-of-the-way durations and rents.

Free Canon, four years plus four

Minimum duration of four years, renewal of four more except in the cases provided for by law. At the second deadline, those who want to renew under new conditions, or not renew, communicate it with a registered letter at least six months before (Art. 2, paragraph 1). The assistant calculates dates and prepares reminders.

Canon agreed, three years plus two

Canon, duration and other conditions follow the local agreements between the organizations of the property and those of the tenants, deposited in each municipality concerned; the minimum duration is three years, then the extension of right of two (Article 2, paragraphs 3 and 5). It is void the clause that gives the lessor a fee higher than the maximum of the agreements for properties with the same characteristics (Art. 13, paragraph 4): the assistant compares the figure with the bands of the municipality agreement, loaded by the agency, and reports the deviations.

Transitorium

It meets the particular needs of the parties, even with a duration less than the ordinary limits; conditions and modalities are set by the ministerial decree recalled by the law (Article 5(1)). The assistant shall record in the file the requirement indicated in the contract and the end date.

For university students

Contracts for the housing needs of students, on the types provided for by law, with canons that the common headquarters of universities can define with local agreements (Article 5, paragraphs 2 and 3).

Each new contract must include the clause by which the tenant declares to have received information and documentation on the energy performance certificate; the copy of the EPA is attached, except in the rentals of individual real estate units (Revenue Agency). To produce the documents in series there is the guide to Document Automation; for remote signature that on contracts and digital signature.

Registration with the RLI model and dry coupon: the deadlines not to be missed

Recording is the step where an error weighs the most, because the data ends up in the IRS archives. All leases must be registered, whatever the rent, except for housing leases that do not exceed 30 days overall in the year between the same parties. The deadline is 30 days from the stipulation or from the beginning, if earlier, and real estate agents must use the telematic services (Revenue Agency RLI card).

The assistant prepares the model data: parts with tax code, cadastral data from the visa, fee, duration, possible option for the coupon. Then compare each field with the signed contract and report the differences before sending, which remains to those who have the qualification.

Fulfillment When Source
Registration of contract Within 30 days of entering into or commencing, if earlier Revenue Agency
Documented communication of registration to tenant and condominium administrator Over the next 60 days L. 431/1998, art. 13
Registration fee for subsequent annuities, if not paid for the entire duration Within 30 days of the expiration of the previous year Revenue Agency
Recommended to the tenant with waiver of updates of the fee Before the option for dry coupon D.Lgs. 23/2011, art. 3, paragraph 11
Confirmation of the coupon in case of extension Within 30 days of the expiry of the previous contract or extension Revenue Agency
Revocation of the coupon Within 30 days of the expiration of the previous year Revenue Agency
Cancellation or renewal under new conditions on the second deadline of a 4+4 Recommended at least six months before L. 431/1998, Article 2

In the ordinary scheme the registration tax for housing is 2% of the annual fee multiplied by the annualities, with a minimum of 67 euros for the first; for the fee agreed in the high-voltage housing municipalities the base falls to 70%. The stamp is 16 euros for every four facades and in any case every hundred lines, and landlord and tenant respond in solid (Revenue Agency).

The flat-rate rental tax (cedolare secca) is an option for an individual landlord who is not renting as part of a business or profession: it replaces IRPEF and the surcharges on rental income, and registration tax and stamp duty are not paid under it. The rate is 21%, reduced to 10% for agreed rents in the municipalities specified by the legislation, and it does not apply if the tenant rents as part of a business or self-employed activity (the Revenue Agency).

A detail for the agency models: Article 3 of Legislative Decree 23/2011, which regulates the coupon, is in force until 31 December 2026. From 1 January 2027 the same rules are read in Articles 203 to 206 of the new Single Income Tax Act, the D.Lgs. 117/2026: it is better to update the references in the clauses and recommended ones.

Short rentals managed by the agency: CIN, Web Accommodation and withholding

Many agencies also manage flats rented for a few days, where the obligations differ. The CIN, the national identification code assigned by the Ministry of Tourism, must be displayed outside the building and included in every listing; the obligation to include it also applies to property intermediaries and portals. Failing to display the CIN or failing to include it risks a penalty of 500 to 5,000 euros for each unit, with immediate removal of the listing (DL 145/2023, art. 13-ter).

The same article recalls for those who rent the obligations of Article 109 of the Single Law of Public Safety: the details of the guests must be communicated to the Police Headquarters through the service Web Accommodation within 24 hours of arrival, or on arrival if the stay lasts less. Data collection before check-in is described in the guide on automation of check-in in short rentals and in the case of WhatsApp agent for short rentals.

The agency then has its own tax obligations. It shall transmit to the Revenue Agency the data of short leases concluded through it by 30 June of the following year and, if it collects the fees or intervenes in the payment, shall operate a withholding tax of 21% as a substitute for tax (DL 50/2017, art. 4); from 2027 the same rules pass into Articles 207 and 208 of the new Single Text. For the owner, from the tax period 2026 the coupon on short leases is valid only if it allocates to this use no more than two apartments; in addition, the activity is considered to be enterprise (Revenue Agency).

The assistant inserts the CIN in each ad and blocks the publication if it is missing, extracts at the end of the year the contracts to be transmitted and separates the collected fees subject to withholding. The tourist tax can be collected before arrival, as in the Automatic payment with Stripe.

Two typical situations in an agency that manages leases

A 3+2 fee agreed. Consider an owner who wants to rent a three-room apartment to a family under an agreed-rent contract. The assistant loads the municipality’s territorial agreement, calculates the rent range using the property details supplied by the agent, and flags that the requested amount exceeds the maximum: the agent discusses it with the owner before signing. It then fills in the template, prepares the RLI data with the cedolare secca flat-rate rental tax option, and the registered letter waiving rent adjustments.

Forty contracts under management. One agency follows forty leases for about twenty owners. The assistant keeps the calendar: annuity of the register for contracts under ordinary regime, ISTAT updates only where there is no coupon, second deadlines of the 4+4 to be communicated in time, no fees arrived. Every Monday the agent receives the list of the week with the documents ready to be reread; for reminders there is the demo on automatic payment reminders.

Where rental management with AI stumbles

The filter that no one has decided. Vague instructions such as ‘prefer reliable candidates’ become opaque rules that reward those who write well in Italian or have a family surname.

The score that becomes judgment. A solvency index shown as a traffic light leads to discarding candidates without anyone looking at the documents.

The ISTAT Update on the Cedular Contract. An automatic letter of adjustment asks the tenant for something the lessor has given up.

The short ad without CIN. Just an ad published without code to expose the agency to sanction and removal.

The documents of the rejected candidates. Payrolls and documents from those who have not taken the house remain in shared folders for years. Establish a storage time and have it applied by the system; the principles are summarized in the guide on AI and GDPR.

The first piece to automate in leases

Start from the deadlines of already registered contracts: use data that the agency already has, does not touch the choice of tenants and shows immediately if the system reads well contracts and receipts. Then come the answer to the requests, with the list of allowed questions, and the compilation of the contract templates. Selection remains a decision of people.

If you want a single stream that holds together requests, contracts, RLI data, and your lease deadlines, the page on automation of business processes explains how we design it, and the one on the AI for real estate It collects the other uses in the agency.

FAQ

Can AI choose a tenant instead of the agent or owner?

Not on the basis of a single automated score. Article 22 of the GDPR gives people the right not to be subject to decisions based solely on automated processing that significantly affects them, which refusing them a home may do. The assistant checks that documents are complete and consistent; the agent and owner make the choice, and the applicant can speak to a person.

Which questions must a chatbot avoid asking someone seeking a rental home?

Nationality, origin, religion, health and anything that would serve only to exclude someone for who they are. Italy’s consolidated immigration law considers it discrimination to deny housing to a lawfully resident foreign national because of that status, even indirectly. Useful questions are different: move-in date, number of occupants, contract type and the guarantees offered.

Who registers a tenancy agreement handled by an agency?

The obligation lies with the parties, landlord and tenant, who are jointly and severally liable for the taxes. If the agency handles registration, it must use the Italian Revenue Agency’s electronic services, which are compulsory for estate agents. The assistant prepares the RLI form data and compares it with the signed agreement; submission is performed by an authorised person.

Can a landlord request an ISTAT rent adjustment under cedolare secca?

No. For the entire duration of the option, the landlord waives rent adjustments, including the ISTAT adjustment, and the option takes effect only if the tenant was notified beforehand by registered letter. The agency’s business management system should flag contracts under cedolare secca and block rent-adjustment letters.

Can rent under an agreed-rent contract be set freely?

No. In agreed-rent contracts, a clause giving the landlord rent above the maximum set by local agreements for properties with the same characteristics is void. The assistant compares the amount with the bands in the municipality’s agreement and flags discrepancies, but the agent checks the final calculation.

What changes in 2027 for cedolare secca and short-term rentals?

The rules move from Legislative Decree 23 of 2011 and Decree-Law 50 of 2017 to the new consolidated income-tax law, Legislative Decree 117 of 2026, which incorporates them. The legislative references in the agency’s contract templates, registered letters and privacy notices should be updated.
